It is a well-known fact that when a couple from two different countries or cultures divorce, the one who must submit to the foreign juridiction often feels at a great disadvantage. The strong feeling that his or her rights as a parent have not been respected as they would have been in the country of origin, pushes that person towards a rejection of everyone and everything having to do with the foreign country. Whether or not that person admits to any faults, he or she rejects the decision of the foreign court and considers himself or herself to be its victim.

This person is playing a role in a bad film and forcing her daughter of 8 years to play a role in it. Unhappily, life is not a film.

The Facts:

1. The mother lost her *statut social*. What following a divorce in which she was deprived of her parental rights, and thus authority over her daughter's upbringing, with all that implies from an *inter-cultural* standpoint. Moreover, she was ordered to pay court costs. (Decision handed down in France in February 1996).

2. Since July 1995, the mother has retained the child and deprived the father and his family of all contact with her.

3. On the basis of false documents, the mother acquired an immigration visa from Mexico to the USA. The daughter appears on these documents as having been born in Mexico of an unknown father.

4. After significant research, the father succeeded in reaching the mother and child by telephone. In fact, the mother placed the call, but the father could not trace its origin. In this conversation the mother had the child demand from her father the sum of US$60,000 and that he renounce custody of the child.

5. The father could not give in to such blatant blackmail. He attempted to reassure his daughter about the future, and, as a temporary measure to keep the child from being in need, sent a substantial sum of money to the mother's bank in Cancun.

6. [Was this in the same conversation or later?] The mother claimed to be suffering from a serious illness which justified her keeping the child. The child told her father that if she returned to him, her mother would die. The mother also claimed that the child herself had a serious heart problem, and demanded more money for an imminent operation. She apparently didn't worry about the inconsistencies in these demands.

This is a modern form of torture, the effects of which, while not comparable to physical torture, are nonetheless devastating, both immediately and in the long term, to the child's development, her image of her father, and her view of men.

It is to be feared that the sexual abuse apparently suffered as a child by ROSA-MARIA, the mother, will lead her to raise her daughter, LEA-MARIE, with wounds that will be difficult to erase.

It will be difficult to change the false idea that LEA is being given that the world is a dangerous place, that the law is the enemy, and that men are a threat to children and women.

We must not forget as well the pain and desolation of the family in France. As much as the father has tried to assure the parents of his former wife that they will see LEA, still they are opposed to LEA's visiting her other grandparents on France.

WHO COULD BELIEVE OF THIS WOMAN:

1. that she used her eight-year-old daughter to extort money ?

2. that she made her daughter think that her father had abandoned them to live with another woman?

3.that she told her daughter that even her father's family in France had abandoned them?

4.that she would be capable of creating false papers to erase all evidence of the father? (We have obtained copies of these documents.)

5.that she pursues a course of harassment against her ex-husband that amounts to psychological torture and forces their daughter to take part?
